GENERAL TERMS AND CONDITIONS (T&C)

1. SCOPE The following terms and conditions apply to all orders placed by consumers and businesses via our online shop (Montessori UK).

A "Consumer" is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An "Entrepreneur" (Business) is a natural or legal person or a partnership acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.

These terms apply exclusively. Differing or contrary terms of the customer shall not apply except if expressly agreed upon in writing.

By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction aids provided in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. You will receive a confirmation email immediately after sending the order.

3. CONTRACT LANGUAGE & TEXT STORAGE The language available for the conclusion of the contract is English. We save the text of the contract and send you the order data and our Terms and Conditions by email. For security reasons, the text of the contract is no longer accessible via the internet after the order has been completed.

4. DELIVERY TERMS Shipping Costs: We offer Free Shipping on all orders within the United Kingdom. Delivery Method: We deliver by courier/mail only. Unfortunately, self-collection of the goods is not possible. Delivery Area: We do not deliver to packing stations (Packstation) unless explicitly stated otherwise.

5. PAYMENT The following payment methods are generally available in our shop:

  • Credit/Debit Card: You enter your credit card details during the ordering process. Your card will be charged immediately after placing your order.

  • PayPal: To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, you must be registered with PayPal, legitimize yourself with your access data, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after placing the order.

  • Apple Pay: To pay via Apple Inc., you must use the "Safari" browser, be registered with Apple, have the Apple Pay function activated, identify yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order.

  • Google Pay: To pay via Google Ireland Ltd., you must be registered with Google, have the Google Pay function activated, identify yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order.

  • Klarna: In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment is made to Klarna:

    • Pay Later: The payment period is 14 or 30 days from shipment of the goods or tickets/availability date of the service.

    • Slice It (Installments): Financing service that allows you to pay your purchase in fixed or flexible monthly installments.

6. RIGHT OF WITHDRAWAL Consumers are entitled to the statutory right of withdrawal as described in our Right of Withdrawal (Refund) policy. (Note: As per our policy, returns are free of charge).

7. RETENTION OF TITLE The goods remain our property until full payment has been made. For entrepreneurs, the following also applies: We reserve ownership of the goods until all claims from an ongoing business relationship have been settled in full.

8. WARRANTY AND LIABILITY FOR DEFECTS 8.1 Statutory Rights We are under a legal duty to supply products that are in conformity with this contract. For consumers, statutory warranty rights under the Consumer Rights Act 2015 apply. This means the goods must be as described, fit for purpose, and of satisfactory quality.

8.2 Process If the product you receive is defective or develops a fault, please contact us at info@montessoriuk.com.

9. LIABILITY We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors; for fraud or fraudulent misrepresentation.

Business Liability: If you are a business customer, we will not be liable to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

10. DISPUTE RESOLUTION & APPLICABLE LAW These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
